Cosy Cabins warranty policy for your peace of mind.
Cosy Cabins provides a warranty to the owner in relation to:
10 year materials performance and workmanship guarantee
of the building
1 year maintenance period (as per Item 12 Building
Agreement)
The builder also provides a warranty in relation to defects in
materials and workmanship for a period of six (6) years from the
date of final payment.
If the builder is notified during the six year period, of any defect
in materials or workmanship covered under this warranty, within
a reasonable period of time from the defect becoming evident,
then the builder will at its option repair or replace the defective
materials and remedy the defective workmanship at its cost.
- Work to be Completed Properly
All building work will be completed in a proper, competent and
professional manner according to the plans and specifications
with the relevant building consents adhered to. The
responsibility of obtaining the building consent under the
Building Act shall be the builders. - Appropriate Materials
The materials used in construction of the building will be
appropriate for the used to which they are put and (unless
stated otherwise in the contract), will be new materials. - Compliance with Legislation
All the building work will be completed in accordance with the
relevant legislation including compliance with the Building Act
and Regulations (including the Building Code). - Standard of Work
The Standard of building work is to be carried out with
reasonable expertise and care and is to be completed as agreed
in the contract between the parties. - Suitability
The building work and materials will be fit for the purpose that
the owner has specified the building is for and it will be suitable
for occupation by the owner at the end of the work. - Insurance
The builder is to arrange for and pay the cost of insurance on
the building work as is appropriate and sufficient for full
replacement of the building work as it progresses. In the event
of a loss the builder agrees to file a claim for the amount of the
loss and use the insurance funds paid (after payment of any
secured debts against the property) in payment to the builder of
any outstanding amounts due. - Exclusions
The following are excluded from this guarantee:
Any loss or damage or deterioration which is beyond the
reasonable control of the builder including (but not limited
to) that caused through normal fair wear and tear, or
through lack of proper maintenance;
Loss or damage or deterioration caused by or as a result of
weather (including but not limited to slips, erosion,
shrinkage or expansion)
Loss damage or deterioration caused by act of God
(including but not limited to earthquake, fire, extreme winds)
Warranty
Materials, goods or products used in the building works
which are covered by separate manufacturers or suppliers
warranties or guarantees are specifically excluded from this
guarantee and the owner agrees to rely on the warranties or
guarantees provided by the manufacturer or supplier of
these materials, goods or products. The materials, goods or
products which are specifically excluded from this contract
are as per the schedule attached to this warranty (with the
relevant guarantee and warranties also being attached)
This warranty is valid only if the terms of payment agreed
between the owner and the builder have been complied
with. - Additional Rights
The rights contained in this Warranty Certificate do not affect
any of the rights the owner has under the Building Act, the
Consumer Guarantees Act, or any other legislation and
regulations which the builder must comply with.
